1. Our Approach to Privacy

  1. At Qminder Limited (“Qminder”, “we”, “our” or “us”) we are committed to protecting your privacy. This Privacy Policy sets out how we collect, store, process, transfer, share and use data that identifies or is associated with you (“personal information”) and information regarding our use of cookies and similar technologies.
  2. We operate the www.qminder.com website (the “Site”), where you can view information about us and our queuing solution software platform (the “Qminder Service”), sign up for the Qminder Service and download documentation about operating the Qminder Service.
  3. This Privacy Policy applies to the Site and the Qminder Service. Please ensure that you have read this Privacy Policy and understood how we collect, store, use and disclose your personal information before accessing or using the Site or the Qminder Service.

2. Who Is Responsible for the Use of Your Personal Information

  1. There are various ways in which we collect and receive personal information about you when you access the Site and use the Qminder Service, and our relationship with you with respect to your personal information will vary depending on our relationship with you, how we collect this personal information and how we use it.
  2. In certain circumstances we will act as the controller of your personal information, which means we determine and are responsible for how that information is used.
  3. In other circumstances we act as a processor or service provider on behalf of our Clients, meaning that we have contractually committed ourselves to use of this personal information only on behalf of and under the instructions of the relevant Client in accordance with our Terms of Service.
  4. The following summarises where we believe we act as a controller and where we would consider ourselves to act as a processor:
    • When you subscribe to the Qminder Service and set up an account on your own behalf in an individual capacity, we will be the controller of your personal information that you provide to us, such as your name and other contact details, your payment details and transaction details (including the details of the type of service you have purchased).
    • When you subscribe to the Qminder Service as the primary administrative contact on behalf of an organisation (the “Client”), we will process most of the personal information we collect as a processor on behalf of the Client. We will, however, also use certain personal information as a controller, such as when we use your contact details to administer our relationship with the Client, when we use support requests to identify ways in which we can improve the Qminder Service, and when we collect data about how the Client’s “Authorised Users” access the Qminder Service to monitor the performance of the Qminder Service.
    • We will only ever collect and use personal information about Clients’ customers as a processor on behalf of the relevant Client.
  5. This privacy policy applies to our use of your personal information when we act as a controller of that personal information.

3. Personal Information You Provide to Us and How We Use It

  1. We collect personal information that you submit directly to us when you use the Site and the Qminder Service. This can include information you provide to us when you subscribe for the Qminder Service, submit questions or correspond with us by phone, e-mail or otherwise in relation to the Qminder Service.
  2. We will indicate to you where the provision of certain personal information is required in order for us to process your subscription for the Qminder Service, respond to your query or otherwise provide you with a functionality of the Site or the Qminder Service. If you choose not to provide such personal information, we may not be able to process your request, provide support or respond to your other questions.
  3. The following tables set out further detail about the categories of personal information we collect about you and how we use that information when you use the Site and the Qminder Service, as well as the legal basis which we rely on to process the personal information.

Personal information we collect from prospective customers

When you contact us to express an interest in the Qminder Service or with a question about becoming a customer of Qminder, we will collect the following personal information:

Personal information we collect from Client administrators

When you sign up to the Qminder Service on behalf of a Client, or if a Client designates you as an administrative user on their account, we will collect the following personal information:

If you were logged in to your Google account when you viewed the ad, we and Google may compare the contact details you provide against the contact details and information about the ads shown to you that Google holds about you. We will only use your personal information in this way to the extent you give us your consent to do so.
Your preferences, such as preferences set for notifications and marketing communications. We use this information to provide notifications, alerts and communications in accordance with your choices. The processing is necessary for our legitimate interests, namely ensuring that we comply with your communication preferences.
We use this information to ensure that we comply with our legal obligation to send only those marketing communications to which you have consented. The processing is necessary for compliance with a legal obligation to which we are subject.

Personal information we collect from you if you are the Client

If you sign up to the Qminder Service in your personal capacity, rather than as an admin on behalf of a Client, we will collect the following information:

We use this information to respond to any enquiries and complaints made by you relating the Qminder Service. The processing is necessary for our legitimate interests, namely communicating with you to respond to your queries or complaints.
We may share your contact details with Google to identify if you subscribed to the Qminder Service after you were shown an ad for the Qminder Service on another website, app or service. If you were logged in to your Google account when you viewed the ad, we and Google may compare the contact details you provide against the contact details and information about the ads shown to you that Google holds about you. We will only use your personal information in this way to the extent you give us your consent to do so.
Your password that you set for accessing the Qminder Service. We use this information to authenticate you and grant you access to the Qminder Service. The processing is necessary for the performance of a contract with you.
The services and functionalities you have purchased on the Qminder Service. We use this information to provide you the features and functionalities you have purchased on the Qminder Service. The processing is necessary for the performance of a contract with you.
We use this information to tailor the content of the promotional messages we send to you. The processing is necessary for our legitimate interests, namely informing our marketing strategy.
Comments and opinions. When you contact us directly, e.g. by email, phone or through the chat functionality on the Site, we will record your comments and opinions. We use this information to address your questions, issues and concerns. The processing is necessary for our legitimate interests, namely communicating with users and responding to queries, complaints and concerns.
If your question is a support request, we use this information to provide technical and other product support in relation to the Qminder Service. The processing is necessary for the performance of a contract with you.
Your job details, such as the type of industry you work in. We use this information to determine products and services that may be of interest to you for the purposes of our direct marketing. The processing is necessary for our legitimate interests, namely to inform our direct marketing.
We use this information to deal with enquiries and complaints made by you relating the Qminder Service. The processing is necessary for our legitimate interests, namely administering the Qminder Service and for communicating with you to respond to your queries or complaints
Your preferences, such as preferences set for notifications and marketing communications and how the Qminder Service is presented to you. We use this information to provide notifications, alerts and communications in accordance with your choices, and to display the Qminder Service in accordance with your preferences. The processing is necessary for our legitimate interests, namely ensuring that we comply with your communication preferences and display the Qminder Service in accordance with your preferences.
We use this information to ensure that we comply with our legal obligation to send only those marketing communications to which you have consented. The processing is necessary for compliance with a legal obligation to which we are subject.
Payment and transaction information, such as your credit card, payment authentication code, billing address, your subscription type and other information such as the groups and accounts you set up on the Qminder Service. We use this information to manage your subscription to the Qminder Service and process the payments you make through the Qminder Service. The processing is necessary for the performance of a contract with you.

All users of the Qminder Service

As mentioned above, we mostly collect and use personal information about users authorised to access the Qminder Service by our Clients as a processor on behalf of the relevant Client. We do also, however, use it as a controller as follows:

4. Personal Information We Collect About You Automatically And How We Use It

  1. We also automatically collect the following personal information about how you access and use the Site and the Qminder Service, and information about the device you use to access the Site or the Qminder Service:

    • Approximate location information. Other than information you choose to provide to us, we do not collect information about your precise location. Your device’s IP address may however help us determine an approximate location.
    • Information about how you access and use the Site and the Qminder Service. For example, how frequently you access the Site or the Qminder Service, the time you access the Site or the Qminder Service and how long you use it for, the approximate location that you access the Site or the Qminder Service from, whether you access the Site or the Qminder Service from multiple devices, and other actions you take on the Site or the Qminder Service.
    • Log files and information about your device. We also collect information about the computer, tablet, smartphone or other electronic device you use to access the Site or the Qminder Service. This information can include details about the type of device, unique device identifying numbers, operating systems, browsers and applications that you use to access the Site and/or Qminder Service on your device, your mobile network, your IP address and your device’s telephone number (if it has one).

We use this information to tailor how the Qminder Service is displayed to you (such as the language in which they are provided to you). We will only process your personal information in this way to the extent you have given us your consent to do so.
We use this information to monitor the performance of and improve the Qminder Service, to resolve issues and to inform the development of new products and services. We will only process your personal information in this way to the extent you have given us your consent to do so.
  1. We may link or combine the personal information we collect about you and the information we collect automatically. This allows us to provide you with a personalised experience regardless of how you interact with us.
  2. We may anonymise and aggregate any of the personal information we collect (so that it does not directly identify you). We may use anonymised information for purposes that include testing our IT systems, research, data analysis, improving the Site and our Qminder Service and developing new products and features.

5. How Long Will We Store Your Personal Information

  1. We will usually store the personal information we collect about you for no longer than the periods set out below. We may, however, need to retain your personal information for longer if we are required to do so by law or if necessary to defend or pursue legal claims.

Information collected automatically for monitoring the performance of the Site and Qminder Service and identifying ways in which we can improve the Site and Qminder Service. Up to 2 years from your last visit to the Site or the Qminder Service.
Information collected automatically for the purpose of interest-based advertising. The longer of: up to 6 months from your last visit to the Site or the Qminder Service, and up to 6 months from the last time you viewed or interacted with an ad for the Qminder Service.

6. Recipients of Personal Information

We may share your personal information with the following (as required in accordance with the uses set out above):

Advertising partners: We may share your personal data with advertisers, advertising exchanges, and marketing agencies that we engage for advertising services, to assist us in advertising the Qminder Service on other websites and measuring the effectiveness of those advertisements. These recipients will process personal information to target advertising relating to the Qminder Service to you on other websites. They may also target advertisements for other products on third-party websites based on cookies or other information indicating previous interaction with us and/or our Site. We will only share your personal information in this way to the extent you have given us your consent to do so.
Purchasers and third parties in connection with a business transaction: your personal information may be disclosed to third parties in connection with a transaction, such as a merger, sale of assets or shares, reorganisation, financing, change of control or acquisition of all or a portion of our business. These recipients will process personal information to assess and complete acquisitions or transfers of our company or business. The legal basis we rely on for sharing personal information in this way is that it is necessary for our and the purchaser’s legitimate interests, namely facilitating and completing transactions to acquire our company or business.
Law enforcement, regulators and other parties for legal reasons: we may share your personal information with third parties as required by law or if we reasonably believe that such action is necessary to comply with the law and the reasonable requests of law enforcement; detect and investigate illegal activities and breaches of agreements, including our Terms of Service; and/or exercise or protect the rights, property, or personal safety of Qminder, its users or others. These recipients will use your personal data in the performance of their regulatory or law enforcement role. The lawful basis we rely on for sharing personal data with these recipients is that the processing is either necessary to comply with a legal obligation to which we are subject, or is necessary for our legitimate interests, namely enforcing our rights or complying with requests from regulatory authorities.

Other than as set out above, we may also share statistics and insights developed by us from your personal information. These statistics and insights are derived from anonymised and aggregated information, such that it would not be possible to identify you (directly or indirectly) or even single you out from this information.

7. Storing and Transferring Your Personal Information

  1. Security. We implement appropriate technical and organisational measures to protect your personal information against accidental or unlawful destruction, loss, change or damage. All personal information we collect will be stored on secure servers operated by third party cloud hosting providers. We will never send you unsolicited emails or contact you by phone requesting your account ID, password, credit or debit card information or national identification numbers.

  2. International Transfers of your Personal Information. The personal information we collect may be transferred to and stored in countries outside of the jurisdiction you are in where we and our third party service providers have operations, including the United States.

  3. Safeguards. In the instance of such a transfer, we ensure that:

    • the personal information is transferred to countries recognised as offering an equivalent level of protection under the UK Data Protection Act 2018 or in a decision of the European Commission (”Adequacy”); or
    • the personal information is transferred to entities certified to the EU-U.S. Data Privacy Framework and UK Extension (”DPF”); or
    • the transfer is made pursuant to appropriate safeguards, such as standard data protection clauses adopted by the European Commission or under the UK Data Protection Act 2018 (”SCCs”).

8. Your Rights In Respect of Your Personal Information

  1. In accordance with applicable privacy law, you have the following rights in respect of your personal information that we hold:
    • Right of access. You have the right to obtain:
      • confirmation of whether, and where, we are processing your personal information;
      • information about the categories of personal information we are processing, the purposes for which we process your personal information and information as to how we determine applicable retention periods;
      • information about the categories of recipients with whom we may share your personal information; and
      • a copy of the personal information we hold about you.
    • Right of portability. You have the right, in certain circumstances, to receive a copy of the personal information you have provided to us in a structured, commonly used, machine-readable format that supports re-use, or to request the transfer of your personal data to another person.
    • Right to rectification. You have the right to obtain rectification of any inaccurate or incomplete personal information we hold about you without undue delay.
    • Right to erasure. You have the right, in some circumstances, to require us to erase your personal information without undue delay if the continued processing of that personal information is not justified.
    • Right to restriction. You have the right, in some circumstances, to require us to limit the purposes for which we process your personal information if the continued processing of the personal information in this way is not justified, such as where the accuracy of the personal information is contested by you.
    • Right to withdraw consent. Where we rely on your consent as the legal basis for processing your personal information, you have the right to withdraw that consent at any time. Withdrawal of your consent will not affect the lawfulness of our processing of your personal information prior to that withdrawal.
  2. You also have the right to object to any processing based on our legitimate interests where there are grounds relating to your particular situation. There may be compelling reasons for continuing to process your personal information, and we will assess and inform you if that is the case. You can object to marketing activities for any reason.
  3. If you wish to exercise one of these rights, please contact us using the contact details at the end of this Privacy Policy.
  4. You may also review and edit some of the personal information you have submitted to us through the appropriate functionality on the Qminder Service.
  5. Due to the confidential nature of data processing we may ask you to confirm your identity when exercising the above rights, such as asking you to confirm certain details that we hold about you.
  6. We will seek to respond to any request relating to your rights within one month of receipt of such request.
  7. Where, given the complexity of the claim or the number of requests received, the above deadline cannot be met, we will inform you of the extended deadline in which we will respond to your request. Such extension may not be more than two months from the date on which we notify you that an extension is required.
  8. Where we do not follow up on your request, we will inform you within the one month deadline of the grounds on which we have based our decision and of you right to refer a complaint to your national data protection authority.
  9. If we are unable to deal with any issues you raise with us, you also have the right to lodge a complaint with your national data protection authority.   10. If you are a California resident, the California “Shine the Light” law gives you the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes. If you have agreed to accept marketing cookies, to opt out of this type of sharing please update your cookie preferences to withdraw your consent by visiting our Cookie Settings in the website footer.

9. Email marketing

  1. From time to time we may contact you with information about our products and services, including sending you marketing messages and asking for your feedback on our products and services.
  2. Most marketing messages we send will be by email. For some marketing messages, we may use personal information we collect about you to help us determine the most relevant marketing information to share with you.
  3. We will only send you marketing messages if you have given us your consent to do so. You can update your preferences about the emails you receive from us at a later date, including withdrawing your consent, by clicking on the link at the bottom of our marketing emails or emailing us at support@qminder.com.

10. Interest Based Advertising

  1. We work with online advertising networks and advertising partners to tailor the ads played or displayed to you on other websites, apps and services.

    How we use personal information to tailor advertising to you

  2. The ads you see online are tailored to your interests based on information collected about you, including information about your age, demographic, location, as well as information about your internet usage over time, such as the websites you visit, the products and pages you view and the links you click on (including links in ads played or displayed to you).

  3. Typically, this information is collected through cookies and similar tracking technologies. When you visit the Site we will, if you give us your consent to do so, place cookies and similar tracking technologies on your device to:

    • Identify you and your device, and share this information with the relevant advertising networks, so that they can serve you advertising based on the information those advertising networks (or the partners they work with) have about your internet usage history;
    • Collect information about how you use the Site so that, when you visit another website that works with the same advertising networks as us, we can play you adverts for the Qminder Service which are tailored to the pages and features of the Site that you accessed.
  4. The services we use for advertising as described above may include certain forms of display advertising and other advanced features through Google Universal Analytics, such as Remarketing with Google Analytics, Google Display Network Impression Reporting, the DoubleClick Campaign Manager Integration, and Google Analytics Demographics and Interest Reporting. These features enable us to use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the Doubleclick advertising cookie) or other third party cookies together to inform, optimize, and display ads based on your past visits to the Site.     How we use personal information to measure the effectiveness of our advertising

  5. We and our advertising partners will measure the effectiveness of the advertising shown to you as you browse other websites, apps and services by assessing whether you visit our Site and/or subscribe to the Qminder Service after being shown an ad for the Qminder Service. This helps us and our advertising partners understand the effectiveness of our online advertising strategy.

  6. If you accept advertising cookies and similar technologies on a website, app or service where advertising for the Qminder Service is played or displayed to you, our advertising partners will record that you have viewed an ad for the Qminder Service and if you clicked on it. If you then visit our Site and/or subscribe to the Qminder Service, and you have agreed to the use of advertising cookies on our Site, we and our advertising partners will record that you visited our Site or made a purchase after seeing an ad for the Qminder Service.

  7. We also work with certain advertising partners to measure offline conversion tracking, meaning that, if you subscribe to the Qminder Service other than through our Site, we will check with the advertising partner if they have a record of you viewing an ad for the Qminder Service before you made that purchase. To do this, we may compare information that we collect when you contact us and subscribe to the Qminder Service (such as your contact details and the name of your organisation) with information that the advertising partner holds (such as your Google account name or email address, if you were logged in to your Google account when you viewed the ad for the Qminder Service).

    How you can control the ads you see online

  8. We will only collect, use and share information about your use of the Site for advertising purposes to the extent you have given us your consent to do so. You can access and customise your preferences at any time by clicking on the floating privacy widget at the bottom of your screen.

  9. Withdrawing or withholding consent, or opting out of the use of advertising cookies, will mean that information about your use of the Site will not be collected and shared with advertising networks to allow us to target advertising on other websites.

  10. If you opt out of advertising by opting out of the use of, or withholding or withdrawing your consent to advertising cookies, you will still get ads when you browse the internet, and those ads may still be relevant to your interests. However, this advertising may be based on the content of the site you visit or, for advertising on social media, your approximate location or demographic information associated with your social media profile, rather than your recent browsing activity. As a result, you may still see advertising relevant to your location, demographic or other information on the websites you visit even if you reject cookies on the Site.

  14. Please note that opting-out of receiving interest-based advertising through the NAI’s and DAA’s or Your Online Choices online resources will only opt you out from receiving interest-based ads on that specific browser or device, but you may still receive interest- based ads on your other devices. You would need to perform the opt-out on each browser or device you use.

  15. Some of these opt-outs may not be effective unless your browser is set to accept cookies. If you delete cookies, change your browser settings, switch browsers or devices, or use another operating system, you will need to opt-out again.

  16. Please note that opting out of interest-based advertising does not mean you will no longer see advertising on your device – it just means that adverts may no longer be tailored to your interests.

11. Cookies and Similar Technologies Used on Our Website
